2. Website Use and Booking Requests

1. Information Accuracy: While we endeavor to keep all information on this website accurate and up to date, pricing, service descriptions, and availability are subject to change without notice.
2. Booking Requests: Submitting a "Request Booking" form through our website does not constitute a confirmed appointment or a binding contract. A binding appointment is only formed once our team contacts you directly to confirm date, time, and service availability.
3. Age Requirement: By submitting a request through our website, you warrant that you are at least 18 years old or have legal capacity to enter into binding contracts in South Africa.

3. Estimates, Quotes, and Work Authorisation

1. Initial Estimates: Any pricing mentioned online or via initial inquiries is an estimate based on information provided by you (Make, Model, Year, reported issues).
2. Detailed Inspection & Quotations: Upon vehicle inspection at our workshop, a formal quotation will be provided for required parts and labor. No additional or work outside the initial quote will be performed without prior customer approval (written, electronic, or verbal).
3. Consumer Protection Act (CPA): In compliance with Section 15 of the South African Consumer Protection Act 68 of 2008, you have the right to request a pre-estimate of costs prior to any diagnostic or repair work being undertaken.

4. Payment Terms & Storage Fees

1. Payment Due Date: Full payment for all parts, labor, diagnostics, and VAT is due prior to or upon collection of the vehicle, unless alternative written payment terms have been agreed upon in advance.
2. Accepted Payment Methods: Payments can be made via EFT, credit/debit cards, or cash at our premises. Vehicle release is subject to clear payment receipt.
3. Storage Charges: Vehicles must be collected promptly once we notify you that the service or repair is complete. Vehicles left uncollected beyond the collection period stated on your invoice may attract a daily storage fee, which will be communicated to you in advance.
4. Lien on Vehicles: In accordance with South African common law, EUTOPIA Automotive exercises a general lien over any vehicle in our possession until all outstanding fees for work performed are paid in full.

5. Warranties on Repairs and Parts

1. Workmanship Warranty: We guarantee our workmanship for the warranty period stated on your invoice, calculated from the date of invoice.
2. Parts Warranty: New replacement parts are covered by the manufacturer's warranty, usually in accordance with the Consumer Protection Act (6-month implied warranty for defective goods).
3. Exclusions: Warranties do not cover damage resulting from failure due to third-party interference, customer negligence, racing, off-road misuse, unauthorized modifications, or normal wear and tear.

6. Vehicle Drop-off, Valuables & Driving Permission

1. Personal Belongings: Customers are strongly advised to remove all cash, electronic devices, personal items, and valuables from the vehicle prior to handing it over. EUTOPIA Automotive accepts no liability for loss or theft of personal items left inside the vehicle.
2. Test Driving Authorisation: By leaving your vehicle with us for servicing or repairs, you grant our qualified technicians permission to drive the vehicle on public roads as necessary for diagnostic testing, quality checks, and performance evaluation.

7. Intellectual Property & Digital Content

All text, images, logos, graphics, and layout on this website are the property of EUTOPIA Automotive and are protected under South African intellectual property laws. Unauthorised reproduction, copying, or redistribution of site content is strictly prohibited.

8. Third-Party Links & Cookies

1. Governing Law: These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.
2. Dispute Resolution: In the event of a dispute arising from a repair or transaction, the parties agree to first seek informal resolution directly. If unresolved, disputes may be referred to the relevant Automotive Ombudsman (MIOSA) or the South African National Consumer Commission (NCC) where applicable.

11. Amendments to Terms

We reserve the right to modify or update these Terms at any time without prior notice. Any changes will be posted on this page with an updated "Last Updated" date. Continued use of our website or services constitutes acceptance of the modified Terms.
